Section 1: scope
Unless otherwise stated, all our sales are governed by these sales terms and conditions that prevail on any purchasing terms and conditions.
Section 2: prices
The applicable prices will be those effective on the date of sales and appearing in the price list above. The prices are in Euro and “ex works”, the transportation fees shall be borne by the purchaser.
Unless agreed between the parties, the payment shall be made at the order.
If a due date has been agreed, no discount shall be granted if the payment is made by anticipation.
Any payment made after the due date mentioned in the invoice shall lead to the payment of penalties, whose amount shall be three times the French legal rate of interest. These penalties are payable without the necessity of a reminder. Moreover, all the recovery costs shall be borne by the purchaser.
In application of the legal provisions, any payment which is overdue by any professional will lead to pay to the creditor a fixed sum of €40, as compensation for recovery costs. However, if the recovery costs are higher than the amount of this compensation, the creditor may request an additional compensation, upon appropriate justification.
Section 3: right of withdrawal
- If the client is a professional: no right of withdrawal may be exercised.
- If the client is a particular client: in the case when the concluded sales is a distance selling or has been made outside the winery estate, the client has a period of 14 days from the date of receipt of the wines to exercise his right of withdrawal.
The winegrower shall make the reimbursement by using the same mean of payment than the one used by the client for the initial transaction, unless a different method has been agreed.
In any case, such reimbursement shall not give rise to costs for the client.
If the client has received the bottles at the moment when he exercises his right of withdrawal, the client shall return them to the estate address without undue delay, and in any case, not later than fourteen days after the date he notified his intention to exercise his right of withdrawal. This deadline shall be deemed to be observed if the goods are returned before the expiration of the fourteen days period.
The direct fees for returning the goods shall be borne by the client.
The client may be liable in case of depreciation of the goods resulting from handling in a manner other than that necessary for ascertaining the nature, characteristics and functioning of the goods.
If the sales have been concluded in a trade fair: the client is not entitled to exercise its right of withdrawal.
Section 4: reservation of ownership
The seller remains the owner of the sold goods until the client pays the full price as principal and incidental. However, at the moment of the delivery, the risks for loss or deterioration shall be transferred to the purchaser.
Section 5: delivery
The delivery shall be made either by direct delivery of the goods to the client, or at the place indicated by the purchaser in the purchase order.
Our wines travel at the addressee’s risks, even if the shipping is made with carriage paid. The seller may not be held liable in case of damage, loss, theft or in case of defective parcels. Consequently, the clients should verify the parcels at the delivery and notify any reservation to the carrier, via registered letter within three working days after the receipt of the goods.
Section 6: disputes
Our sales are governed by the laws of France. Any dispute shall be exclusively under the authority of the court in the jurisdiction where the seller has its domicile.
